1. Acceptance of Terms

By accessing or using tectm ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

tectm is a project cost control platform for commercial construction. It provides tools for managing budgets, programs, dockets, payment claims, variations and site records. The Service is provided to organisations, not to individual consumers.

3. User Accounts

Access to the Service is by invitation. You must be at least 18 years old and authorised to accept these terms on behalf of your organisation. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorised use

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Violate any applicable laws or regulations

5. Your Data

You retain all rights to the data you upload to the Service. You grant us a limited licence to use, store, and process your data solely to provide the Service to you. We will not share your data with third parties except as described in our Privacy Policy.

6. AI Features

Parts of the Service use AI to read contract documents, extract data and draft correspondence. Content you process this way is sent to third-party AI providers. See our Privacy Policy for who they are and what they receive. AI output is a starting point, not advice: it can be wrong or incomplete, it is not legal or financial advice, and you remain responsible for checking anything you rely on against the source document. AI features can be disabled for your organisation on request.

7. Fees

Access during a pilot is provided free of charge. Where fees apply, they are set out in the written agreement with your organisation and billed in advance. We will give at least 30 days' notice before changing fees.

8. Termination

You may stop using the Service at any time. We may terminate or suspend your account for violation of these terms. On termination you will have a reasonable period to export your data before it is deleted.

9. Disclaimers

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Subject to that, the Service is provided "as is". We do not warrant that it will be uninterrupted or error-free, and you remain responsible for the decisions you make using it.

10. Limitation of Liability

Subject to section 9, and to the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or any loss of profits or revenue.

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses arising from your use of the Service or violation of these terms.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

13. Changes to Terms

We may update these terms from time to time. We will notify you of any material changes by email or by posting a notice on the Service.
